DISTANCE SALES AGREEMENT
1. PARTIES
1.1. SELLER
In this Agreement, the term "Seller" refers to "HalalWorld" that provides consumers with accommodation and tourism services through an online platform or call center, operating in accordance with the applicable legislation.
1.2. BUYER-CUSTOMER
The Buyer's/Customer's name, surname, Turkish ID number/passport number, phone number, address, and e-mail information are included in the RESERVATION FORM, which is an INTEGRAL PART OF THIS AGREEMENT.
2. DEFINITIONS
In this Agreement; WEBSITE: the website accessible online within the framework determined by the Seller, where various services and content are provided, CALL CENTER: the call center operated by the Seller, SELLER: the Seller itself, BUYER or CUSTOMER: the person(s) who purchase the service through the website or the Call Center.
3. SUBJECT OF THE AGREEMENT
The subject of this Distance Sales Agreement is the sale of the accommodation service whose DETAILS are included in the RESERVATION FORM, which is an INTEGRAL PART OF THIS AGREEMENT, the purchase of this accommodation service by the Customer, and the provision of such service by the Seller/Supplier.
4. SERVICES AND PAYMENT INFORMATION
The total price of the accommodation service to be purchased or reserved, including taxes, shall be notified before the completion of the purchase and/or reservation process. The Customer shall not be responsible for additional costs, expenses, commissions, or fees under any name that may be demanded by banks or other intermediaries in transactions made especially by credit card.
5. GENERAL PROVISIONS
The Customer acknowledges that, before this Agreement was executed, he/she was clearly and understandably informed via the website or call center regarding the essential characteristics of the Products and Services subject to this Agreement, the total sales price including all taxes, and the method of payment, as well as the Seller's trade name and contact details.
6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The Customer acknowledges that he/she has been informed of the characteristics of the purchased service through the Preliminary Information Form and/or the brochure.
6.2. The Parties declare and accept that, in addition to the terms of this Agreement, they will act in compliance with the provisions of Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation.
7. CONSENT FOR COMMERCIAL ELECTRONIC MESSAGES
The Customer consents to being informed by the Seller/Supplier, its operated brands, suppliers, service providers, partners, stakeholders, and business collaborators about services, advertisements, announcements, campaigns, and activities, and to receiving commercial electronic messages, e-mails, SMS, etc.
8. PROCESSING OF PERSONAL DATA AND DECLARATION OF CONSENT
Within the scope of this Agreement, the Customer's personal data is processed, stored domestically and abroad, and protected by the Seller/Supplier in accordance with the Law No. 6698 on the Protection of Personal Data.
9. RESOLUTION OF DISPUTES
For disputes arising from the implementation of this Agreement, the Consumer Arbitration Committees located at the place where the Buyer purchased the goods or where the Buyer resides shall be competent for disputes up to the monetary limit announced by the Ministry of Trade.
10. FINAL PROVISIONS
In refund transactions under this Agreement, if the payment was made by credit card, a 5% bank commission fee shall be deducted from the refund amount. By signing and paying by credit card, the Customer accepts this deduction.
