Please read these Terms of Service (“Terms”) carefully. These Terms govern the conditions for using all online booking services provided through the platform operated by HalalWorld, based in the Netherlands (“HalalWorld”, “we”, “us”, “our”). They also cover your interactions with us.
1. DEFINITIONS “You”, “User” or “Customer”: The person using the Services provided by HalalWorld. “Travel Service”: Accommodation, transportation, experiences, car rental, or any other travel-related service. “Travel Supplier”: The third-party provider that directly delivers the Services. “Platform”: The website, mobile application, and all related digital infrastructure owned by HalalWorld through which the Services are offered. “Booking”: A binding transaction made through the Platform between the User and the Travel Supplier.
2. APPLICATION AND UPDATES OF THE TERMS HalalWorld provides an online platform through which users around the world can make reservations for various travel services such as accommodation. By using our Platform or making a booking, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept the Terms, please do not use our Services. HalalWorld reserves the right to amend these Terms from time to time. Such changes may be made, for example, in order to: Make the Terms clearer and easier to understand, Comply with legislation or tax regulations in the jurisdictions where we operate, Reflect innovations in our service infrastructure, operations, or security policies.
The effective date of the updated Terms is indicated at the beginning of the document under the heading “Last Update Date.” If a change significantly affects your rights or obligations, we will notify you within a reasonable time by methods such as email or an announcement on our website. However, if the change must take effect immediately due to a legal or tax obligation, or for security reasons, we will inform you as soon as possible. Your continued use of our Platform after the changes have been made means that you accept the new Terms. If you do not agree to the changes, you must stop using our Services. Existing bookings will remain subject to the Terms that were in effect at the time of the transaction. We recommend that you read these Terms carefully and keep a printed or digital copy for your records.
3. SCOPE AND LIMITATIONS OF THE SERVICE HalalWorld acts as an intermediary platform that enables bookings between Users and Travel Suppliers. HalalWorld does not provide services directly. Through the Platform, Users can: Search and compare Travel Services, Make bookings, Make payments, Create memberships, Share content (reviews, ratings, etc.).
In addition to these Terms, separate terms and conditions set by Travel Suppliers (for example, the terms and conditions of an accommodation provider) also apply to your booking. To make a booking through the Platform, you must accept the applicable rules and restrictions of the selected Travel Supplier (e.g., payment obligations, cancellation terms, refund conditions, capacity limits, additional fees, or service coverage). These rules are presented to you before the booking is completed. By explicit reference, such rules and conditions form an integral part of these Terms of Service. If you violate the Travel Supplier’s rules: a. Your booking may be canceled, b. Your access to the service may be denied, c. You may lose your right to a refund. These matters are entirely subject to the Supplier’s terms. As an intermediary, HalalWorld is not the party managing refund processes of suppliers. Additionally, for some bookings in certain countries, when payment is received, the transaction may fall under the EU Value Added Tax Directive (2006/112/EC), specifically Articles 28 and 306–310, or under certain local legal regulations. Equivalent national laws of the relevant country may also apply. In such cases, the party acting as the supplier of certain Travel Services may be the direct service provider or an affiliated company instead of HalalWorld. The applicable terms and conditions in such a case will be those of the relevant supplier (e.g., the accommodation provider’s own terms).
4. ACCOUNT CREATION AND USER OBLIGATIONS The digital infrastructure provided by HalalWorld is designed to allow users to access information about various Travel Services and to make reservations securely. Our Platform is not suitable for uses other than this purpose. By using our Services, you expressly agree to: Use our Services only for your personal travel needs, not for commercial purposes, Be at least 18 years old and legally capable of entering into binding agreements under applicable law, Use our Platform only in compliance with applicable laws and these Terms, Ensure that all information you provide is accurate, current, complete, and not misleading, If making a booking on behalf of another person: obtain their prior consent, inform them of all applicable terms (including the Travel Supplier’s Rules and Restrictions), ensure they accept and agree to comply with those terms, and take full responsibility for all booking-related actions (payment, cancellations, change requests, etc.).
You further agree not to: Make false, misleading, or fraudulent bookings, Copy, monitor, or attempt to access the Service content via any automated system (spider, bot, scraper, etc.) or manual process, Attempt to bypass, disable, or tamper with access restrictions or security measures (e.g., robot blocking), Engage in any technical activity that may cause unnecessary or excessive system load on our infrastructure, Provide deep links to our Service, Integrate our Platform into another website (through “framing”, “mirroring” or similar techniques) to reproduce content without authorization.
HalalWorld reserves the right to take technical and legal measures against violations of these restrictions. HalalWorld also reserves the right, based on legitimate reasons and within reasonable limits, to deny or restrict any individual’s access to our Platform or to other services, applications, or digital tools accessible through a HalalWorld user account. We may also make improvements or structural changes to our Platform at any time for reasons such as security, functionality, user experience, or legal compliance. Such changes will always be implemented in a manner consistent with transparency and fairness, without unjustly restricting users’ fundamental rights. 4.1. Account Creation To fully benefit from our Platform, you must create a user account (“Account”) with HalalWorld and log in. You must be at least 18 years old and provide accurate and complete information requested during registration. Creating an Account not only gives you access to the HalalWorld platform but may also grant access to other online services provided by HalalWorld group companies (such as booking systems, applications, travel assistant tools, etc.) using the same login credentials. However, such services may be subject to separate terms of use specific to each platform. By creating an account and logging into our Platform, you agree to: Keep your login credentials confidential and not share them with others, Be personally responsible for all activities carried out through your account – regardless of whether they were authorized by you, Immediately notify HalalWorld if you become aware of any unauthorized use of your account, Provide any mandatory information requested by HalalWorld without delay to ensure compliance with applicable legal regulations.
If you wish to delete your account, you can follow the relevant steps through your user panel or check our Help section for updated procedures. For more details on how your personal data is processed and your rights of access and deletion, please refer to our [Privacy Notice]. 4.2. Ranking of Search Results Since the HalalWorld platform provides access to a wide variety of travel options, we strive to optimize search results to show you the most suitable services. The ranking of accommodation options that appear after a search is based on default criteria defined in our system. However, as a user, you can also rank the results according to your own preferences. For example, you can filter and sort by: Price range, Guest review score, Type of accommodation, Amenities and other criteria.
You can find more detailed information about how our ranking system works [here]. From time to time, certain travel options may also be highlighted in search results as part of a paid promotion by specific Travel Suppliers. These promoted options are clearly marked with terms such as “Advertisement,” “Sponsored,” or similar, to ensure transparency. Our aim is to adhere to the principle of transparency in search results by clearly explaining both how our ranking algorithm works and the nature of commercial displays. 4.3. Third-Party Redirection and External Booking Services During certain transactions carried out via the HalalWorld platform – for example, for specific services such as car rental – you may be redirected to third-party booking systems. In such cases, the contracting party of the booking will not be HalalWorld but the relevant third-party service provider. This redirection takes you to a different digital environment, and all subsequent steps are carried out within the systems and terms of that third-party provider. Because HalalWorld has no control over such external booking processes: It cannot be held liable for any direct or indirect damages arising from these transactions, It assumes no responsibility for the commitments, cancellation policies, price changes, or service quality of third-party providers.
The terms and conditions of the relevant service provider should clearly define your rights and the provider’s obligations. In every case, we strongly recommend that you carefully review those terms before completing a booking. 4.4. Booking Confirmation Every booking you make will be confirmed with a “Booking Confirmation” sent to you by email. This confirmation includes all essential details such as the scope of the Travel Services booked, their main features, and the total price. These documents are provided in a storable and accessible format in line with our legal information obligations. If you do not receive a confirmation within 24 hours after completing your booking, please contact us immediately. This is important for early detection of possible technical issues and to ensure your trip is planned smoothly.
5. PRICES, PAYMENTS AND TAXES The prices of Travel Services displayed on our Platform are valid as shown, unless expressly stated otherwise or in the case of obvious typographical or calculation errors. HalalWorld brings together a wide range of services offered by different Travel Suppliers and takes the utmost care to display all prices correctly. However, Travel Service prices are dynamic and may change over time depending on market conditions, currency fluctuations, seasonality, or provider policies. Such price changes will not affect previously confirmed and communicated bookings – except in cases of obvious error. If you have a booking and a clear pricing error is detected in our system, we will notify you and offer two options: Continue your booking at the correct and valid price, Cancel the booking without any penalty.
In cases of obvious and exceptional errors that a reasonable user could recognize (for example, if the service price is displayed at an unusually low rate), even if a Booking Confirmation has already been sent to you, we are not obliged to provide the service at the incorrect price. The total prices displayed for our Services may include, depending on the case, the following types of taxes and collection fees: Value Added Tax (VAT), Goods and Services Tax (GST), Sales Tax, Accommodation Tax (e.g., city tax, tourism tax), Collection service fees or other similar legal charges.
These taxes are usually included in the price displayed at the time of booking but may sometimes be shown as separate items during the payment step. Calculations are made on the gross amount before loyalty points, coupons, promotions, or discounts subsidized by us are applied. Such discounts are not considered deductible items for tax purposes. In addition, in some countries or cities, specific local taxes (e.g., city tax or per-night tourism contribution) may be collected directly by the accommodation provider or through one of HalalWorld’s group companies. In such cases, these taxes and payment obligations will be clearly communicated to you during the booking process. If the applicable tax rates change between the booking date and the check-in date, the total tax amount payable may increase, and this difference may be collected during your stay. 5.1. Payment Process and Authorized Collection Companies Payments made during the booking process are processed in the applicable local currency and through valid payment systems. The entity receiving the payment may vary depending on the country or region where the payment takes place. For this purpose, HalalWorld and its affiliates may work with companies registered in different jurisdictions and licensed payment intermediaries. Depending on the service location specified at the time of booking, your payment may be collected by one of the following representative or affiliate companies: Location Authorized Company Receiving Payment Turkey, Netherlands, Germany, France, Italy, Spain, Belgium, Austria, Portugal, Greece, Ireland, Sweden, Norway, Denmark, Finland, Romania, Bulgaria, Poland, Czech Republic, Hungary, Croatia, Slovenia, and other EU/EEA countries HalalWorld (registered in the Netherlands) United Kingdom HalalWorld United States HalalWorld Canada HalalWorld Switzerland HalalWorld United Arab Emirates, Saudi Arabia, Qatar HalalWorld Turkey (when using local payment systems) HalalWorld Turkey Liaison Office or authorized payment intermediary Other countries One of HalalWorld’s affiliates or an authorized payment processor
If your payment is collected by a HalalWorld group company listed above (or a third-party payment service provider acting on its behalf), the law applicable to the payment contract will be that of the country where the collecting company is established. However, this does not affect the main governing law of the general Terms of Use (e.g., Dutch law). If you choose to securely store your credit card, debit card, or alternative payment details in our system for future transactions, such data will only be processed based on your explicit consent and in accordance with our [Privacy Notice]. Your stored payment details will be processed and stored exclusively for the purpose of service provision, in compliance with the security protocols defined by GDPR (EU General Data Protection Regulation) and KVKK (Turkish Personal Data Protection Law). Verification of Payment Method and Bank Fees By making a reservation, you authorize our designated company (e.g., HalalWorld or one of its affiliates listed above) or the relevant Travel Supplier to perform the following actions in order to verify the validity and suitability of your payment method: Verify your payment method by charging a small amount to your card or by other means of pre-authorization, After successful verification, collect the booking amount from your payment instrument.
These actions are carried out through payment service providers in compliance with applicable laws. When making international bookings, the bank that issued your credit or debit card may apply additional fees to the transaction. Such fees are determined entirely by your bank’s policies and are beyond HalalWorld’s control. For example: If the Travel Supplier operates in a country different from the country where your bank is located, the transaction may be considered an international or cross-border transaction and an additional fee may apply, If you choose to make the reservation in a currency different from the local currency of your card, or if the booking amount is charged in a different currency, your bank may convert the amount using its own exchange rate and charge you a foreign currency conversion fee.
The type, rate, and timing of these fees depend entirely on your bank or card issuer’s own contract terms. HalalWorld and its affiliates have no control over the amount, timing, or application of such charges. For detailed information about possible transaction fees or currency conversion costs, please contact your bank or card issuer directly. HalalWorld accepts no responsibility for any additional costs arising from such charges or currency fluctuations. Currency Exchange and Currency Information The exchange rates displayed on our Platform are obtained from official market sources and are provided for information purposes only. The rates shown may change between the booking date and the travel date, and HalalWorld makes no commitment regarding fluctuations or accuracy of exchange rates. Alternative Payment Methods To facilitate the payment process, HalalWorld may from time to time collaborate with consumer finance companies or alternative payment providers (for example, financial institutions offering installment payment services). However, this does not mean that we recommend or guarantee the services of such providers. If you choose to use an alternative payment method: All legal responsibility and risk lie with you, The transaction is subject to the specific terms and conditions of the payment provider, HalalWorld cannot be held responsible for the content, practices, or negligence of these providers.
We strongly recommend that you carefully review the terms of the relevant provider before using any alternative payment channel. Fraud Prevention, Misuse, and Suspicious Activities To protect the security and legality of the platform, HalalWorld may request additional information or verification documents if there is reasonable suspicion regarding any reservation or user account, including: Signs of fraud, identity theft, or forgery, Misuse or manipulation of the Service, Connection with individuals or entities subject to international sanctions, Unauthorized or unusual transaction activities.
If such a situation is reasonably identified, HalalWorld reserves the right to take the following measures: Cancel existing bookings associated with your name, email address, or account, Temporarily suspend or permanently close the relevant user account, Seek legal remedies to recover damages and, if necessary, notify the competent authorities.
These security measures are taken to protect both you and other users of the platform. Ensuring legal compliance of transactions and protecting parties from potential harm are among HalalWorld’s priorities. If you wish to request additional clarification about the cancellation of a reservation or the closure of your account, please contact us directly. We will strive to provide you with a clear and prompt response.
7. CHANGES, CANCELLATIONS, AND REFUND CONDITIONS 7.1. Cancellation or Change by the User If you wish to cancel or change an existing booking (for example, travel dates, destination, accommodation address, or transport details), please contact us directly. However, if the applicable rules and restrictions of the Travel Supplier do not allow such changes or cancellations, you will not be entitled to do so. Suppliers may charge you a fee for full or partial cancellation or modification of a booking. These fees are specified in detail in the Rules and Restrictions document. You acknowledge and agree that you are responsible for all costs arising from such changes and that you will pay the relevant fees. When a booking is modified, the price of the new booking will be determined according to the rates in effect at the time the change is requested. This price may differ from the original booking price. In general, changes made closer to the travel date tend to result in higher prices. To understand the applicable terms and conditions of cancellation or modification, you must carefully review the Travel Supplier’s Rules and Restrictions presented to you at the time of booking. Examples: If you book accommodation and request cancellation/changes after the deadline specified in the cancellation policy, you may be required to pay a cancellation fee. Some properties do not allow any cancellations or changes. For “Pay Later” bookings, if you fail to check in or cancel on time, the property may apply a “no-show” or late cancellation fee, which will be charged directly to you. If you do not use all or part of the booked services, whether you are entitled to a refund will be determined according to the applicable Rules and Restrictions.
These statements are subject to applicable consumer law and do not affect your statutory rights. If the Travel Supplier allows cancellations or modifications but charges a fee for the process, HalalWorld may also apply a fixed administrative fee. If such a fee applies, you will be informed clearly before the cancellation or modification is processed. 7.2. Cancellation or Change by the Supplier or HalalWorld If the payment or cancellation/change fees related to your booking are not paid on time, your booking may be canceled by the Travel Supplier or HalalWorld. Additionally, your booking may be canceled or changed by HalalWorld or the Travel Supplier for various reasons, such as: Duplicate bookings for the same accommodation in the system, Natural disasters (e.g., hurricanes, floods), Closure of the property or inability to provide the service for various reasons.
In such cases, we will contact you as soon as possible to: Try to offer you alternative service options, Provide assistance, or Take the necessary steps to ensure a refund where appropriate.
Refund Policy If you are entitled to a refund, the refund will be made using the same payment method used during the initial booking. The refund will be processed by the party that collected the payment at the time of booking (HalalWorld or the relevant Travel Supplier). HalalWorld cannot directly intervene in or guarantee the Travel Supplier’s refund process, speed, or decisions, nor does it have detailed knowledge of them. Unless otherwise specified at the time of booking, fees charged by HalalWorld are non-refundable.
8. SPECIFIC PROVISIONS FOR TRAVEL SERVICES This section sets out special conditions relating to certain types of services offered by Travel Suppliers. These provisions are examples and do not replace the detailed Rules and Restrictions provided to you during the booking process. The specific terms of the relevant Travel Supplier are directly binding on your booking. In the event of a conflict between this section and the Rules and Restrictions, the Rules and Restrictions will prevail. Before making a booking, we recommend that you carefully review both this section and the special terms provided by the supplier. 8.1. Accommodation Services When booking through our Platform, you may be offered two different payment options: Pay Now, Pay Later.
Both options include applicable taxes and service fees in the displayed price. However, the amount of these taxes and fees may vary depending on the chosen payment method. In addition, exchange rates and tax rates may differ between the time of booking and the date of stay. If you choose the Pay Now option, payment is completed at the time of booking. The payment is collected via your selected payment method by the authorized company (HalalWorld or one of its affiliates) as specified under the Payments section above. In the Pay Later option, payment is usually collected directly by the Travel Supplier. Collection is carried out either in local currency at check-in or at the amount communicated at the time of booking. The payment method and timing will also be specified in your booking confirmation. Some accommodation providers may request a credit card authorization or a cash deposit at check-in to cover any additional expenses during your stay. This security deposit is separate from and independent of the payment collected by HalalWorld or its affiliates during the booking process. Failure to Arrive on the First Night If you do not check in on the first night of your booking but still intend to stay for subsequent nights, you must inform HalalWorld before the scheduled check-in date. Otherwise, the accommodation provider may cancel the entire booking. Any refund rights in such cases will be evaluated solely according to the provider’s Rules and Restrictions. Group Bookings Bookings for nine (9) or more rooms at the same property for the same dates cannot be made through the Platform. Even if booked under different reservation numbers, if the total number of rooms exceeds eight (8), HalalWorld reserves the right to cancel your reservations. A cancellation fee may apply, and if a non-refundable deposit has been paid, it may not be reimbursed. For requests of nine (9) rooms or more, please contact us directly. Such bookings may require signing a written contract or paying a non-refundable advance payment. Star Ratings and Quality Assessments The star ratings or quality classifications of accommodations displayed on our Platform are general information tools intended to guide user expectations. Where applicable, these ratings may be provided by authorized institutions according to local or national standards. However, rating systems differ from country to country. Thus, the same star rating may represent different service levels in different places. HalalWorld emphasizes that these ratings are not a guarantee of quality, a commitment to specific services, or a legally binding statement. To form accurate expectations, we recommend that users carefully review the property’s detailed information page. Rating systems may be updated or changed over time, and HalalWorld does not guarantee the accuracy of any displayed ratings. Meal Arrangements If meals are included in your accommodation booking, the scope of such services depends on the length of your stay. The following standard definitions are provided as general guidance and may vary depending on the property’s policies: Full board generally includes breakfast, lunch, and dinner, Half board usually includes breakfast plus either lunch or dinner.
The exact content, serving hours, and style of meals will be explained to you at the time of booking or during your stay. If one or more meals are not consumed by the guest, no refund will be provided for the unused services.
9. INTERNATIONAL TRAVEL AND REQUIRED DOCUMENTS International travel bookings made through HalalWorld may involve various risks depending on the destination country, current health conditions, security policies, and legal entry requirements. Some destinations may carry higher safety, health, or political risks than others. Therefore, before planning and during your trip, you are advised to regularly consult official travel advisories and recommendations published by relevant authorities such as the foreign ministry, embassies, or consulates of the destination country. HalalWorld does not declare or guarantee that travel to any country is completely safe. The User makes travel and booking decisions at their own discretion and risk. Health Conditions and Vaccination Requirements Health entry requirements of your destination country may vary. As a user, you are responsible for: Having all required health documents (e.g., vaccination certificates such as COVID-19, yellow fever), Receiving all mandatory or recommended vaccinations and/or medications, Obtaining an individual risk assessment from a healthcare professional before traveling and following medical advice.
Some countries may impose specific health regulations even for transit passengers. Such requirements may change after the booking date. Passports, Visas, and Travel Documents Up-to-date information about passport validity, visa requirements, and electronic travel authorizations (e.g., ETIAS or ESTA) must be obtained from the embassy, consulate, or official authorities of the destination country. Ensure that all documents are complete and valid before departure, Plan your trip to allow sufficient time to obtain required permits, Delays in visa processing, deportation, or entry refusal due to missing documents are outside HalalWorld’s responsibility.
If the Travel Service cannot be completed due to missing or invalid travel documents, HalalWorld assumes no liability. This also applies in cases where entry is denied for part of the trip, or if you are stranded at an airport/port during the journey. In some countries, airlines or transport providers are legally required to share passenger information (e.g., passport details, nationality, date of birth) with local authorities. Such data may be collected during booking or at check-in at the airport. HalalWorld is not directly involved in these processes; inquiries should be directed to the transport provider. HalalWorld does not make any representation or guarantee that travel to certain destinations is “recommended” or risk-free. HalalWorld cannot be held liable for damages, losses, delays, cancellations, or restrictions arising from such travel. Users are responsible for evaluating the risks and consulting official sources when making travel choices. Providing necessary documents such as passport, visa, vaccination, and other health-related papers is solely the User’s responsibility. HalalWorld is not responsible for deportation or entry refusals.
10. LIABILITY 10.1. Liability Regarding Travel Services HalalWorld acts as a booking platform and is not the direct provider of Travel Services offered through the platform. All Travel Services are delivered by independent third-party Travel Suppliers. Therefore, the performance and quality of the services booked are the responsibility of the relevant supplier. When HalalWorld or one of its affiliates acts as the Travel Supplier, liability will only apply under the following conditions: The damage you suffer is directly connected to a fault in HalalWorld’s service delivery, The damage is of a nature that both you and HalalWorld could reasonably foresee, The damage arises directly from HalalWorld’s action or negligence.
In such cases, HalalWorld’s total liability shall not exceed the total amount you paid to HalalWorld for the specific Travel Service concerned. In all other cases where HalalWorld is not acting as a supplier but only as an intermediary platform, it assumes no liability – to the maximum extent permitted by law – for any direct or indirect damages arising from services provided by Travel Suppliers. Liability for Services Provided by Travel Suppliers To the maximum extent permitted by law, HalalWorld assumes no responsibility for: The quality, suitability, or performance of services provided by Travel Suppliers, Any actions, omissions, warranties, statements, errors, or failures of such suppliers, Any personal injury (including death), material loss, or other damages arising from these actions.
All content provided by Travel Suppliers to our Platform (e.g., property details, images, star ratings, pricing, Rules and Restrictions) is based on the suppliers’ own representations. The accuracy, currency, and completeness of such information are the responsibility of the suppliers. HalalWorld is obliged to transmit this information to users as provided, but cannot be held liable for inaccurate or misleading content unless directly at fault, nor does it give any guarantee regarding such information. Images, descriptions, and ratings of accommodations are provided for informational purposes only and do not constitute any guarantee. The display of any Travel Service on the Platform does not mean it is endorsed or recommended by HalalWorld. Information, software, content, links, functions, and booking facilities available on our Platform are provided “as is” and “as available.” To the maximum extent permitted by law, HalalWorld does not guarantee: That the Platform or its servers are free of harmful software (e.g., viruses, trojans), That content will always be delivered error-free, uninterrupted, and securely, That identified errors or defects will be corrected immediately.
Indirect Damages and Limited Liability To the extent permitted by applicable law, HalalWorld shall not be liable for: Delays, cancellations, or availability issues not caused by the Travel Services themselves, Any inability to use or access our Services, Any content or links accessed through our Services,
and shall not be responsible for any indirect, consequential, incidental, punitive, or special damages – even if HalalWorld was previously informed of the possibility of such damages. If a court or competent authority holds HalalWorld directly liable for damages, such liability will be limited to: Damages that are reasonably foreseeable by both you and HalalWorld, Actual damages directly related to our own actions,
and HalalWorld’s compensation obligation shall not exceed either the total amount you paid to HalalWorld for the relevant booking or 100 USD (or the equivalent in local currency), whichever is higher. These limitations reflect a risk allocation between the parties and shall remain valid even if any legal remedy provided under these Terms fails. Force Majeure HalalWorld shall not be held liable for failure to perform its obligations due to force majeure events, including but not limited to: Natural disasters, war, civil unrest, terrorist acts, Government decisions, disruptions in air traffic or port operations, Strikes in the transportation sector (e.g., airlines, hotels), Cyberattacks or general infrastructure failures.
Obligations are suspended until the force majeure event ends, and neither party shall be held liable for non-performance during this period. Compensation / Indemnification In connection with your use of our Services, you agree to fully indemnify, defend, and hold harmless HalalWorld, its affiliates, subsidiaries, directors, employees, and representatives acting on behalf of HalalWorld (collectively, the “HalalWorld Group”) from and against any claims, demands, actions, damages, losses, penalties, costs, and expenses (including reasonable legal and accounting fees) brought by third parties arising out of: Your breach of these Terms of Service or other referenced documents, Your violation of any applicable law, regulation, or third-party rights (e.g., intellectual property, personal data, privacy, contractual rights), Your use of our Services or any Travel Services booked through our Platform, Any content you submit, upload, or share via our Platform.
This indemnification obligation applies only if the damages are not caused by HalalWorld’s own direct fault. Right of Defense and Duty of Cooperation In the event of a dispute in which HalalWorld is involved for the above reasons, HalalWorld reserves the right to conduct its own defense and retain full control of the proceedings. You agree: Not to settle or resolve such disputes (e.g., settlement, acknowledgment, compromise) without HalalWorld’s prior written consent, To provide all reasonable documents, information, and cooperation promptly and completely to allow HalalWorld to defend itself, That HalalWorld will notify you without undue delay if such a claim arises.
Waiver For any disputes, disagreements, or transactions (including bookings, payments, content use, damages, indemnities, etc.) between you and Travel Suppliers, other third-party service providers, or websites associated with these services, you agree: Not to hold HalalWorld, its affiliates, directors, employees, or representatives liable in any way, Not to make any legal claims, complaints, or compensation demands against them, Not to require HalalWorld to be directly involved in the dispute resolution process.
This waiver applies only where HalalWorld is not directly a party to the dispute. However, if the dispute arises from a service directly provided by HalalWorld or one of its affiliates – for example, where HalalWorld acts as the Travel Supplier – this waiver does not apply, and the general rules of liability remain in effect.
11. CONTENT AND INTELLECTUAL PROPERTY When you submit or authorize the submission of content (reviews, ratings, images, suggestions, or other materials) on HalalWorld’s platforms, you grant HalalWorld B.V. and its affiliates the following worldwide rights: A non-exclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, translate, distribute, publish, make public, display, and create derivative works from the submitted content in any medium and format, now known or developed in the future, for any purpose worldwide.
Accordingly, HalalWorld may freely use such material for promotion, development, marketing, or analysis of the platform without any obligation to compensate you. By submitting content, you also declare and guarantee that you are legally entitled and authorized to submit it, and that if the content includes trademarks or other protected rights, you are also authorized to grant their use. HalalWorld and its affiliates have the right to initiate legal proceedings and defend intellectual property rights against anyone infringing content submitted by you. Additional User Representations and Acknowledgments By submitting or authorizing content on our Platform, you further acknowledge and agree that: HalalWorld Group may, at its sole discretion, use your name and city of residence in anonymized or non-identifiable format alongside your content (e.g., in a user review), Such content may also be shared with relevant Travel Suppliers for quality improvement or evaluation purposes.
Content you submit or authorize: Is not confidential or proprietary, Does not grant you exclusive ownership claims, Must not be misleading or deceptive.
Unless expressly stated otherwise in these Terms, your submissions or communications with HalalWorld do not create a confidential, fiduciary, or special contractual relationship. All legal responsibility for content you submit remains with you, and it must comply with HalalWorld’s content rules. Waiver of Moral Rights and Content Processing Rights By submitting or authorizing content, you waive any moral rights (e.g., the right to attribution, the right to integrity) and agree that: You will not object to the publication, use, modification, or deletion of the content or its derivatives by the HalalWorld Group or its licensees, You waive the right to request that any personal identifiers linked to the content be used.
HalalWorld Group may process, publish, display, modify, or delete your content without prior notice. Ownership and Intellectual Property Rights All content uploaded to the Platform is subject to HalalWorld’s content rules, which you are obliged to follow. All content on the Platform (texts, images, graphics, software code, logos, brand names, and designs) is the property of HalalWorld and/or its affiliates and is protected under copyright, trademark, and other intellectual property laws. The HalalWorld name and logo are registered trademarks of HalalWorld. Other logos, trademarks, and company names on the Platform may belong to third parties and are used for identification or informational purposes only. Unless expressly permitted, copying, reproducing, processing, or using any part of the Platform (text, graphics, designs, etc.) for commercial purposes without HalalWorld’s written consent is prohibited and may result in legal action. Third-party tools (e.g., Google Translate) may be used to provide translations of user-generated content (e.g., accommodation reviews). Since these translations are generated automatically, errors or inaccuracies may occur. HalalWorld makes no warranties regarding the accuracy, completeness, or reliability of such translations, and their use is at your own risk. All content on our Platform is provided for personal, non-commercial use only. You agree to: Use Platform content solely for personal reference, Comply with all copyright notices, legal disclaimers, and restrictions included in such content, Not copy, reproduce, store, or use Platform content (such as search results, hotel details, user reviews) for commercial purposes without HalalWorld’s written consent.
Our Platform may contain links to third-party websites for reference and informational purposes. HalalWorld has no control over such sites and assumes no liability for their content, accuracy, or availability. HalalWorld may terminate relationships with users or providers who repeatedly infringe intellectual property rights. If you believe any content on our Platform infringes your intellectual property rights, please contact us.
12. SOFTWARE AND USE OF ARTIFICIAL INTELLIGENCE All software available for download through our Platform or via a mobile app store (e.g., App Store, Google Play) are copyrighted works developed by HalalWorld, its affiliates, or third-party suppliers, or are provided under special licenses for public distribution. Your use of such Software is subject to the applicable End User License Agreement (EULA), if any. Before downloading, installing, or using the Software, you must accept the EULA. If no separate EULA applies, HalalWorld grants you only a non-exclusive, non-transferable, non-sublicensable, limited license to download, install, and use the Software for personal, non-commercial purposes related to our Platform or affiliated services. This license is granted free of charge and is strictly limited to the intended use. All Software (e.g., HTML code and similar components) on the Platform is owned by HalalWorld or its suppliers and is protected by national and international copyright laws and treaties. Key restrictions: Reproduction, duplication, sale, rental, or redistribution of the Software is prohibited, Copying or transferring the Software to another server or location, whether for commercial or personal use, is strictly prohibited, Violations may lead to serious civil and criminal penalties, and HalalWorld reserves the right to take legal action.
If a warranty is provided for the Software, it applies only under the terms stated in the relevant EULA. 12.1. Artificial Intelligence Some features and tools on the HalalWorld platform use artificial intelligence technologies, including generative AI. In developing these features, HalalWorld may: Use its own proprietary technologies, Integrate with third-party service providers or large language models, Process the data you provide and the content generated by AI in order to deliver services, improve products, perform quality control, and resolve issues. All processing is carried out under these Terms of Service and our Privacy Notice.
HalalWorld adheres to the principle of transparency. Therefore, all AI-generated content on the Platform will be clearly marked with the label “Generated by Artificial Intelligence” or with a badge so that users can easily recognize it. All AI-generated content (such as travel plans, suggestions, photos, or videos) is the exclusive property of HalalWorld. Users are granted only a non-exclusive, non-transferable, limited license to use such content for personal, non-commercial purposes. Copying, reproducing, distributing, or using AI-generated content for commercial purposes without HalalWorld’s prior written consent is strictly prohibited and may result in legal action. While HalalWorld strives to ensure that AI-generated content is accurate and useful, users should be aware that: Such content is produced by algorithmic systems and may not always reflect the most up-to-date information or take all variables into account, It is provided “as is” and “as available.”
HalalWorld makes no guarantees regarding the relevance, accuracy, or completeness of AI-generated content, nor regarding any losses or damages arising from reliance on such content. To the maximum extent permitted by law and subject to the limitations set forth in these Terms, HalalWorld shall not be liable for any direct, indirect, or consequential losses or damages resulting from the use of AI services. HalalWorld also reserves the right to modify or update AI-generated content.
13. PRIVACY AND PERSONAL DATA At HalalWorld, we place great importance on the confidentiality, privacy, and security of the personal data you provide to us. We will collect, process, and store your personal data only in accordance with the principles and purposes specified in our Privacy Notice and in compliance with legal requirements. For detailed information on how your personal data is processed, what rights you have, and how you can exercise those rights, please carefully review our Privacy Notice published on our Platform. When using our Platform, if you transmit personal data of third parties (for example, when making a reservation on behalf of others), you are deemed to have agreed to protect such data with at least the same level of care you use for your own personal information (a reasonable standard of protection). To the maximum extent permitted by law, you are fully responsible for any misuse, loss, unauthorized access, or disclosure of such third-party information, and HalalWorld assumes no liability in this regard.
14. CONTACT AND COMPLAINTS For any questions or complaints regarding your bookings or travel experience, HalalWorld is ready to assist you. On our Frequently Asked Questions page, you can find many pre-prepared answers to common issues. For live support or written communication, please contact us via the Support Page on our Platform. If you encounter a problem with the Travel Service you booked, wish to file a complaint, or believe you are entitled to compensation from the Travel Supplier, HalalWorld will try to support you and the Supplier in resolving the issue. Please note the following important points: Whenever possible, report issues to HalalWorld or directly to the Travel Supplier before or during your trip, Problems not reported during the trip may reduce both HalalWorld’s and the Supplier’s ability to assist and may limit or eliminate your right to compensation.
If it is not possible to report an issue before or during the trip (for example, if it arises on your return journey), please notify HalalWorld or the relevant Travel Supplier as soon as possible afterwards. HalalWorld recommends submitting complaints within 30 days after the trip. 15. OTHER PROVISIONS Applicable Law and Jurisdiction These Terms of Service shall be governed by the laws of the Republic of Turkey, taking into account both our users in Turkey and HalalWorld’s headquarters in the Netherlands. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Turkish courts, with Istanbul/Turkey designated as the place of jurisdiction. Non-Enforcement of Provisions If HalalWorld fails to enforce or delays enforcement of any provision of these Terms, this shall not constitute a waiver of that provision or affect future enforcement of any other provision. Entire Agreement These Terms of Service constitute the sole and entire agreement between you and HalalWorld regarding the Service and supersede all prior or contemporaneous agreements and statements (whether electronic, written, or oral). Assignment and Transfer HalalWorld may assign, subcontract, or fully transfer its rights, duties, or obligations under these Terms to another party. However, users are not permitted to transfer their rights or obligations under these Terms to any third party. HalalWorld will not carry out any assignment or transfer that reduces users’ rights or guarantees. Severability If any provision (or part of a provision) of these Terms is declared invalid, illegal, or unenforceable by a competent court or authority, the remaining provisions shall remain valid and enforceable. The invalid or unenforceable provision shall be deemed severed from these Terms if necessary. Travel Insurance Unless expressly stated otherwise, travel insurance is not included in the prices displayed on the Platform. Users are strongly advised to obtain separate travel insurance for cancellations or unforeseen risks (e.g., accidents, illness, emergency repatriation). Users are solely responsible for verifying the scope and adequacy of any insurance policy purchased. HalalWorld may act only as an intermediary in presenting insurance products from providers, in which case the relevant policy terms and provider details will be clearly displayed. Third-Party Rights Unless expressly stated otherwise, these Terms do not create any rights or enforceability for persons or entities who are not a party to them. No third-party consent is required for any waiver, modification, or termination of these Terms. Survival of Obligations Any provisions of these Terms that are expressly or by nature intended to survive termination or expiration shall continue in effect after the agreement ends. Records and Tax Information HalalWorld is established in the Netherlands and operates globally. It complies with the local laws and tax obligations of every country in which it offers services. In certain markets, especially specific cities or states (e.g., the USA, Turkey, EU member states), local taxes or occupancy taxes may apply. HalalWorld is registered with local tax numbers and authority certificates in such jurisdictions. Users will be transparently informed during booking or payment about any applicable sales tax, value-added tax (VAT), city tax, or accommodation occupancy tax.
